What Is a Non-QM Mortgage?

Non-QM does not mean unregulated or no-documentation. It means the income is verified a different way.

The Definition

A Qualified Mortgage is a loan meeting standards set under the Dodd-Frank Act — limits on points and fees, no risky features such as negative amortisation, and income verified through prescribed documentation. Loans meeting those standards give lenders legal protection.

A non-QM loan sits outside those standards. That is all the term means. It does not mean the loan is unregulated, that ability to repay is ignored, or that documentation is waived. Every non-QM loan still verifies that the borrower can repay — using evidence other than tax returns.

Non-QM is not subprime

The comparison to pre-2008 subprime lending is the most common misconception. Subprime loans of that era frequently involved no verification at all, negative amortisation and teaser rates that reset sharply. Non-QM loans verify ability to repay, are fully amortising or clearly disclosed as interest-only, and are made to borrowers who typically have substantial equity and good credit.

What Non-QM Costs

Expect a rate roughly 1% to 2% above a comparable conventional loan, a down payment of 10% to 25% depending on programme, and credit minimums between 620 and 680.

The premium is the price of documentation flexibility, not of borrower risk in the traditional sense. Many non-QM borrowers have stronger balance sheets than conventional borrowers — their income simply does not present in the format agency underwriting requires.

Who Non-QM Is Actually For

Self-employed borrowers whose write-offs suppress reported income. Real estate investors past the ten-property conventional cap. Retirees with assets but little taxable income. Borrowers with a recent credit event still inside agency seasoning windows. Buyers of properties agencies will not accept, such as non-warrantable condos.

What these have in common is that the borrower is creditworthy and the file simply does not fit the agency box.

The Refinance Path

Non-QM is frequently a bridge rather than a destination. Borrowers use it to buy now, then refinance into conventional pricing once two years of returns support the income, a credit event ages out, or a condo project resolves its litigation.

Build that into the decision. Ask about prepayment penalties at application — common on non-QM and usually negotiable — because a five-year penalty can make an early refinance uneconomic.
